General Terms and Conditions of Website Use

These General Terms and Conditions of Website Use (hereinafter: General Terms or Terms) govern the use of the website currently accessible at untamed.hr and any of its sub-domains (hereinafter: Website).

The Terms apply between all individuals or entities accessing the Website (hereinafter: user(s) or you) and Untamed d.o.o., a company with its registered seat at Zadravečka 11, Zagreb, Croatia, OIB: 69583807388, registered with the Court Register under registration number (MBS): 081371051, official email [email protected] (hereinafter: Untamed, we, us, or our), as the owner of this Website.

In addition to these Terms, you are required to comply with all applicable policies, rules, sporting regulations and guidelines that govern the use of services or products available on the Website. These policies, including but not limited to the Event Regulations, the Privacy Policy and the Shopper Terms and Conditions available on the Website, form an integral and binding part of these Terms.

By using the Website, you acknowledge and agree that you are legally bound to adhere to these policies, as well as all applicable laws and regulations. We do not recognize any deviating conditions of the user unless we have expressly agreed to their validity in writing.

Individuals under the age of 18 are permitted to use this Website only under the supervision of a parent or legal guardian.

Please note that no part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer, and our acceptance of that offer is deemed to occur only when we send you a confirmation email indicating that your order has been accepted.

Organizer

The website provides a platform where users can access a wide range of offerings, including paying entry fees or training fees for sports and other events, memberships to sports clubs, and purchasing a variety of related equipment, merchandise, and services available for purchase (hereinafter: Products). These Products are facilitated and offered by event managers and sports clubs (hereinafter: Organizer).

The Organizer has authorized Untamed to conclude contracts with users regarding the Products offered through the Website, in the name and on behalf of the Organizer, and to accept the corresponding payments with a debt-discharging effect in favor of the Organizer.

When accessing the Products via the Website, users direct Untamed to facilitate a contract between them and the Organizer. This process involves Untamed handling the user registration, accepting the entry and training fee or payment for Products on behalf of the Organizer, and forwarding it accordingly. Untamed may also manage related communications between the user and the Organizer to ensure a seamless interaction.

By submitting a registration or placing an order for the Product, the user makes an offer to enter into a contract with the Organizer. Untamed reviews these offers and, upon approval, accepts them on behalf of the Organizer. Through this process, a contractual relationship between the user and the Organizer is established.

It may happen that Untamed acts as the organizer of a specific event or sells certain Products directly. In such cases, all provisions stated for the Organizer also apply to Untamed.

In addition to these Terms, users who use the Website to enter into contracts with Organisers and to purchase Products, are also subject to the Shopper Terms and Conditions. If the Product also relates to participation in a specific event, then it is also subject to the Event Regulations.

While we strive to ensure that all descriptions of Products available for purchase on the Website accurately reflect the services and products provided by the Organizer, we are not responsible for any variations. The exact nature of the Products is the Organizer’s responsibility and may vary based on individual requirements and circumstances. Please refer to the Shopper Terms and Conditions and Event Regulations for further details.

No contractual relationship is established between Untamed and you as the end customer of the Products. Untamed acts only as an intermediary and provides you with services related to the processing of the purchase of Products. All aspects of service fulfillment for events linked to the Products, including cancellations, reversals, and other adjustments, as well as issues related to product defects, returns, exchanges, and refunds, are handled directly and exclusively between the Organizer and you as the customer.

Services Provided by Untamed

Untamed provides services through the Website designed to facilitate the offering and purchase of Products and to enable contractual relationships and interactions between users and Organizers. These services include, but are not limited to:

Product Offering and Management: Untamed enables the display and discovery of a wide array of Products offered by Organizers.
Purchase Processing: Untamed manages the purchase process, from initial user interest to final transaction.
User Registration and Account Management: Untamed offers user registration services that enable users to create and manage their accounts
Event Participant Registration: Untamed enables Organizers to register participants for their events and collects their personal data in accordance with the Privacy Policy.
Communication Support: Untamed may facilitate communication between users and Organizers, and to offer a query response service to communicate with users on behalf of Organizers.
Contractual Assistance: Untamed assists in the drafting and execution of contracts between users and Organizers for the purchase of Product.

Availability

We cannot guarantee that Products will always be available, and availability is only confirmed upon order confirmation. Availability indications on the Website may not account for other orders placed during your visit.

Pricing

Pricing information is correct at the time of publication. We, along with Organizers and club representatives, reserve the right to change prices and modify or remove special offers as needed. All prices include and indicate VAT if applicable. Untamed’s VAT Registration Number is HR69583807388 and Organizer’s VAT is stated on the invoice for purchased Product.

For details regarding orders, provision of services, cancellation of orders and services, and refund policy please refer to the Shopper Terms and Conditions and Event Regulation, which are incorporated into these Terms by reference.

Account Creation and Payment Information

In order to access the Products offered on this Website and access certain other features of the Website, you may be required to create an account (hereinafter: Account). Accounts may contain personal information and other details necessary for acquiring the Products, such as credit/debit card numbers, bank account details, and sort codes (collectively referred to as: Billing Information). The specific Billing Information required may vary depending on your use of the Website, as payment details may not be required until you choose to make a purchase.

By continuing to use this Website, you represent and warrant that:

All information you submit is accurate and truthful;

If We terminate your Account, any current or pending orders or payments associated with your Account will be canceled, and the provision of services will not commence.

Any invalid provision will be replaced by one that most closely reflects the intent and purpose of the original in a legally permissible manner. This also applies to any omissions or gaps in the Terms.

These Shopper Terms and Conditions, together with General Terms and Conditions of Website Use and Privacy Policy govern sale of the products and services offered and provided on the website currently accessible at untameds.hr and any of its sub-domains (hereinafter: Website) (hereinafter: Shopper Terms).

Shopper Terms apply between all individuals or entities accessing the Website (hereinafter: user(s) or you) and Untamed d.o.o., a company with its registered seat at Zadravečka 11, Zagreb, Croatia, OIB: 69583807388, registered with the Court Register under registration number (MBS): 081371051, official email [email protected] (hereinafter: Untamed, we, us, or our), as the owner of this Website.

This document forms an electronic contract between Untamed and the user, and by accepting it both sides accept all rights, obligations and responsibilities specified in it.

By creating a user account or registering on the Website, and by submitting an offer to buy (referred to on the Website as an “order”) or purchasing a product, the user is deemed to have fully read, understood, and accepted the Shopper Terms.

You may only purchase the Products if you are at least 18 years old.

We may amend Shopper Terms from time to time.

Product and Services

The Website provides a platform where users can access a wide range of products including the right to participate in events, memberships to sports clubs, and a variety of related equipment, merchandise, and services available for purchase (hereinafter: Products). These Products are facilitated and offered by event managers, organizers and sports clubs (hereinafter: Organizer).

The Website allows users to search for, purchase currently available Products, and obtain confirmation that the ordered Product has been paid and that they have secured the right to participate in events offered by the Organizer. For providing such services related to the purchase of Products (hereinafter: Services) Untamed may charge a service fee (hereinafter: Service Fee).

Order Process

If the Product is advertised and available on the Website, and you wish to purchase it, you should place an order and make a payment in accordance with the Shopper Terms.

To place an order for the Products, you must first create an Untamed user account (hereinafter: Account) and provide the necessary account details as specified. Alternatively, if you already have an Account, you must log in by entering your username or email and password.

By placing an order for a Product, the user is making an offer to enter into a contract with the Organizer for the acquisition of the Product, and concurrently, an offer to access Services provided by Untamed

After you place the order, you will receive a confirmation that your order was received along with relevant information for making the payment for the ordered Product(s). If you are a new customer who registered an account simultaneously with the placement of your order, you will also receive an email confirming that your Account was created. However, this is not yet confirmation that your order was completed.

Untamed reviews all submitted offers and, only after the user makes a payment and upon approval, formally accepts them. Untamed will now send a confirmation to the user acknowledging that the payment was received and the order is now completed.

At this point of confirmation, a contract regarding the provision of Services is established between Untamed and the user, and similarly, a contract regarding the acquisition of the Product is established between the user and the Organizer.

Account Terms

To be a registered user and have created Account, you agree to:

(a) Provide true, accurate, current, and complete information about yourself or one who you are registering for the specific event as prompted by the site registration form (hereinafter: Registration Data), including information required for participant event registration and participation tailored to the specifics of the particular event (hereinafter: Event Registration Data) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

For safety, organizational and technical reasons, we reserve the right to suspend or terminate or modify use of all of your Accounts and refuse any and all of your current or future use of the services (or any portion thereof) or purchase of the Products.

You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your Account, including, without limitation, all actions by sub-users (e.g. riders, mechanics, supporters and others) registered under your account. You agree to (a) immediately notify us of any unauthorised use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss, damage or other liability arising from your failure to comply with this Section or from any unauthorised access to or use of your account. In the event of any dispute between two or more parties as to account ownership, you agree that we shall be the sole arbiter of such dispute in its sole discretion and that our decision (which may include termination or suspension of any account subject to dispute) shall be final and binding on all parties.

Payment

Currently the only available payment method for purchasing the Products and Services on the Website is via direct bank transfer. All payments must be made to the designated account in favor of Untamed.

In future, Untamed reserves the right to enable users to use other payment options without the need to amend these Shopper Terms.

Prices

Pricing information is correct at the time of publication. We, along with Organizers and club representatives, reserve the right to change prices and modify or remove special offers as needed.

It should be noted that prices of individual events, services, and products may vary depending on the date, and are regularly variable depending on the event, class, category, and other specificities.

All prices include and indicate VAT if applicable. Untamed’s VAT Registration Number is HR69583807388 and Organizer’s VAT is stated on the invoice for purchased Product.

Please note that in the case of purchasing a Product that enables participation in a specific event, the Organizer may require participants to meet certain conditions that could incur additional costs (e.g., having specific equipment and being tested for COVID-19). In connection with this, Untamed is not responsible for such additional costs.

The Service Fee is included in the price of each Product, ensuring that the price displayed on the Website is the final price.

Membership Regulations

When you purchase a club membership, you may be required to adhere to specific terms and conditions of the club and its membership rules. Such rules will be indicated on the Website if applicable.

Event Regulation

When you purchase Products that enable participation in a sporting event (e.g., a rally race or training session) (hereinafter: Event), participants are required to follow additional specific terms, conditions and rules related to that Event. This includes obligation to abide by the Sporting rules (e.g. Supplementary Regulations) determined by the Organizer and published on the Website or available in the Account. However, if the Website does not specify such particular rules for the Event, then the herein stated standard terms, conditions and rules for sporting events (e.g. refund and cancelation rule, liability rules for riders) (hereinafter: Event Regulations), will apply. Such rules are binding for all users and participants.

Refund Policy

Below are the refund rules that will apply if the Organizer does not specify its own refund policy on the Website prior to your purchase of the Products. By purchasing a Product, you agree to the terms of the Refund Policy as they form part of the contract:

Full Refund for all Products (100%): Available if the cancellation is made within 15 days from the purchase of the Product.
Partial Refund for the Event (up to 80%): Available if the cancellation is requested more than 60 days before the Event.
50% Refund for the Event: Available if the cancellation is made between 60 and 30 days before the Event.
No Refund: Cancellations made less than 30 days before the Event are not eligible for a refund.

Proof of Cancellation: To qualify for a refund, you must provide valid documentation, such as photographs, medical records, or other evidence showing you are forced to withdraw.

How to Request a Refund: All cancellation requests must be sent in written form to [email protected] together with your registration details and any supporting documentation.

Event Cancelation

The Organizer reserves the right to cancel the Event.

If the Organizer cancels or materially delays or alters the Event or makes a significant change to the date of the Event

Notification: The Organizer will promptly inform participants about the cancellation of the Event.
Compensation Options: Organiser may offer customers the right to attend a different Event at no additional charge and if customer agrees to this, it shall not be entitled to any refund.
Refund Options: The Organiser may issue a refund of Event fee at the Organiser’s sole discretion acting reasonably.
Handling Fees: The Organizer is entitled to deduct necessary expenses incurred in connection with the processing, recording, and refunding of the payment.

All aspects of service fulfillment for events, including cancellations, reversals, and other adjustments, as well as issues related to product defects, returns, exchanges, and refunds, are managed directly and exclusively between the Organizer and the user as the customer. The Organizer is not responsible or liable for any chargebacks related to your purchase of the Products. Untamed acts solely as an intermediary on behalf and in the name of the Organizer. If you wish to request a refund for a Product, Untamed will only issue refunds if explicitly instructed to do so by the Organizer.

Transfer of Event Entry

Any transfers of Event entry to a third party are subject to the prior consent of both Untamed and the Event Organizer.

Liability Limitations

Neither Untamed nor the Organizers shall be liable for any indirect, special, incidental, or consequential damages arising from your use of the Untamed platform, participation in any Events or purchase of the Product. This limitation applies to all causes of action under the law.

Events are subject to change and may be canceled due to factors beyond our control, including but not limited to natural disasters, strikes, or political unrest. In such cases, Untamed and the Event Organizers disclaim any liability for losses or inconveniences experienced by participants.

Neither Untamed nor the Organizers are responsible for the actions of third parties involved in the event nor for unauthorized actions that affect participant data.

The Services provided by Untamed are available on an “as is” basis. We do not warrant that all information on our platform is exhaustive, accurate, or up-to-date at all times.

Participants are expected to conduct their due diligence by reviewing the credentials and legal standing of Events and Organizers. By registering for an event, participants accept all risks, including personal injuries and loss of property

Users and participants agree to indemnify, defend, and hold harmless Untamed and the Event Organizers from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with their actions at Events.

Shopper Terms Revision

We may revise these Shopper Terms from time to time in response to changing legal, technical, or business developments. The updated Shopper Terms will take effect as soon as they are published on the Website. Please check the Shopper Terms periodically to ensure you are familiar with the most current version.

Events Outside Our Control

Untamed or Organizer will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below

An Event Outside Our Control means any act or event beyond our reasonable control[, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an Event Outside Our Control occurs that affects the performance of Untamed’s or the Organizer’s obligations: (a) they will contact you as soon as reasonably possible to notify you; and (b) their obligations under the contract will be suspended, and the time for performance of their obligations will be extended for the duration of the Event Outside Our Control.

Each clause of these Shopper Terms is independent of the others. Should any court or authoritative body determine that a clause is invalid or unenforceable, the remaining clauses will continue to be valid and enforceable.

Our failure to enforce the Shopper Terms or to act with respect to a breach by you does not waive our right to act with respect to subsequent or similar breaches. Waivers by us only take effect if they are provided in writing.

These Shopper Terms are governed by Croatian law. Accordingly, the use of our services and the purchase of products through our site, as well as any disputes or claims arising out of or in connection with them, will be governed by Croatian law. Both you and we agree that the Croatian courts will have non-exclusive jurisdiction to settle any disputes or claims.

Event Regulations

When you purchase Products that enable participation in a sporting or other event (e.g., a rally race, training session, moto tour) (hereinafter: Event) or when you register to participate for the Event, you and all persons accompanying you at the Event are required to follow additional specific terms and conditions and sporting regulations related to that Event. However, if the Website does not specify such particular rules for the Event, then these general regulations will apply (hereinafter: Event Regulations).

Event Regulations are binding for all Website users and Event participants and all persons accompanying them at the Event.

Refund Policy

Full Refund for all Products (100%): Available if the cancellation is made within 15 days from the purchase of the Product.
Partial Refund for the Event (up to 80%): Available if the cancellation is requested more than 60 days before the Event.
50% Refund for the Event: Available if the cancellation is made between 60 and 30 days before the Event.
No Refund: Cancellations made less than 30 days before the Event are not eligible for a refund.

Proof of Cancellation: To qualify for a refund, you must provide valid documentation, such as photographs, medical records, or other evidence showing you are forced to withdraw.

How to Request a Refund: All cancellation requests must be sent in written form to [email protected] together with your registration details and any supporting documentation.

Event Cancelation

The Organizer reserves the right to cancel the Event.

The Organizer may modify or cancel parts of the Event (e.g., stages of the Rally route) due to: adverse weather conditions and orders from authorities (e.g., police, forestry, hunting associations). In such cases you agree that no compensation, refund, or reimbursement will be due and that the Organizer is not liable for any resulting costs or losses.

If the Organizer cancels or materially delays or alters the Event or makes a significant change to the date of the Event:

The Organizer will promptly inform you about the cancellation of the Event.
Organizers may offer you the right to attend a different Event at no additional charge and if you agree to this, you shall not be entitled to any refund.
The Organiser may issue a refund of Event fee at the Organiser’s sole discretion acting reasonably.
The Organizer is entitled to deduct necessary expenses incurred in connection with the processing, recording, and refunding of the payment but

Transfer of Event Entry

Any transfers of Event entry to a third party are subject to the prior consent of both Untamed and the Event Organizer.

Liability Limitations

Neither Untamed nor the Organizers are responsible for the actions of third parties involved in the event nor for unauthorized actions that affect participant data.

The Services provided by Untamed and Products offered on the Website are available on an “as is” basis. We do not warrant that all information on our platform is exhaustive, accurate, or up-to-date at all times.

Acknowledgment of Risk and Participant Responsibility

Participation in an Event such as rally race, training or moto toure involves numerous inherent risks, including but not limited to:

Driving on public roads without traffic closure or special regulation.
Navigating difficult and inaccessible terrain, with unpredictable weather, and natural or man-made obstacles (e.g., animals, logs, fences, strings, ramps, people, or other vehicles).
Potential minefield proximity and dangerous terrain in off-route areas.
Limited and delayed access to medical/emergency services due to the remoteness of the Event routes.
Exposure to road and environmental hazards and actions of other Event participants or third parties.

By participating in the Event, you voluntarily accept these risks and confirm that there are no medical conditions that would make your participation dangerous.

You waive all current and future claims against the Organizer, its members, volunteers, safety team, contractors, and collaborators for any injury, disability, death, property loss or damage incurred during the Event. This includes damage caused by third parties, road or weather conditions, or accidents during the Event.

You also accept full responsibility for any damages or harm you may cause to third parties or their property and agree to indemnify the Organizer in case of any resulting claims, costs, or legal actions.

Insurance and Equipment Requirements

You confirm that you hold appropriate insurance coverage as required by law and the Organizer, which covers your participation in the Event and driving along the Event route.

You also declare that your vehicle and equipment are properly maintained and suitable for the Event.

The Organizer reserves the right to refuse or terminate your participation at any time and without explanation.

Medical Aid and Emergencies

You authorize the Organizer and its representatives to provide first aid and arrange transport to medical providers in case of injury. You release the Organizer from all liability related to such assistance.

Due to the remote nature of Event routes (including those across Bosnia and Herzegovina and Croatia), emergency support may be limited, delayed, or inaccessible.

Border Crossings

If the Event crosses international borders (e.g., Croatia ↔ Bosnia and Herzegovina), you acknowledge that:

The Organizer does not guarantee or facilitate border crossings.
You are responsible for having valid travel documents and complying with border procedures.
You will not hold the Organizer liable for issues or delays at the border.

Media, Image Rights, and Data Usage

By participating in the Event, you grant the Organizer and its authorized third parties the right to record, publish, and use your name, likeness, voice, performance, and biographical details, images or footage of your participation

These may be used for promotional, commercial, or any other purposes in all media, globally and without time limitation. You waive any rights to review, approve, or receive compensation for such uses.

Bivouac Disclaimer

Event bivouacs (e.g., Hotel & Restoran “Kod Šukija”, Polača) are not formal campsites and may have limited infrastructure (toilets, electricity, water) and ongoing construction. Use of the bivouac and surrounding area is at your own risk.

The Organizer is not responsible for loss or damage to your vehicles or personal belongings at the bivouac, does not provide accommodation as part of your Event registration and is not liable for incidents occurring near public roads adjacent to the bivouac.

Device Handling

If you provide any personal devices (e.g., GPS, roadbook) to the Organizer for navigation setup, you accept that the Organizer is not liable for data loss, corruption, or equipment malfunction.

Transfer of Entry

Transferring Event entry to another person is only allowed with prior written approval from the Organizer.

General Conduct & Rules

All participants and attendees must comply with all safety, ecological, and conduct rules, all Organizer instructions, published or provided on-site or on the Webit, all laws and regulations applicable in Event locations.

Violation of any of the above may result in removal from the Event without refund.

Final Provisions

These Event Regulations form an integral part of the contractual relationship between the participant and the Organizer. By registering for the Event or purchasing related Products, the participant confirms that they have read, understood, and accepted these Regulations in full.

These Regulations may be amended or updated by the Organizer at any time. The version in force at the time of your registration shall apply unless otherwise specified.

If any provision of these Regulations is found to be invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.

These Regulations shall be governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising out of or in connection with these Regulations or the Event shall be subject to the exclusive jurisdiction of the competent court in Zagreb, Croatia, unless mandatory legal provisions require otherwise.
